These terms govern your access to and use of Attesian's registry, certificates, and verification tools (the “Service”), operated by Attesian as a venture of Ubuntu Capital. By using the Service, you agree to these terms.
1. The agreement
This is a legal agreement between you and Attesian. If you use the Service on behalf of an organisation (such as a gallery or venue), you confirm you are authorised to bind that organisation, and “you” includes it.
2. Eligibility & accounts
- You must be at least 18 years old to hold an account.
- You are responsible for the security of your account credentials and for activity under your account.
- You must provide accurate information and keep it up to date.
3. Your record & content
An artist's record belongs to that artist. You keep all rights in the content you add — images, descriptions, and history (“Content”). You give us permission to store, display, and use that Content only to run the Service, including creating and checking certificates and producing the price ranges described in the Privacy Policy.
You represent that you have the rights necessary to submit your Content and that it does not infringe anyone else's rights or misattribute a work.
4. Certificates & checking
A certificate is a snapshot of a record at a moment in time: who made the work, a digital fingerprint of the image, and a summary of its history. Anyone can check it by scanning its QR code, without an account. A certificate confirms that a record existed in a certain state at a certain time and was signed by us. It is tamper-evident: any change to it can be detected.
A certificate does not by itself prove that every claim inside it is true. The Service shows how well each entry is backed up — including whether it was simply noted by one person or confirmed by others — and you should read a certificate together with those labels.
5. Not an appraisal
Any price information the Service produces is a broad range, clearly labelled. It is expressly not a valuation, appraisal, tax opinion, or insurance figure, and must not be relied on as one. We take no cut of sales and do not benefit from higher figures. Histories and certificates are records — not guarantees of authenticity, condition, legal ownership, or market value.
6. Confirmations & accuracy
The Service records what happened and shows how well each entry is backed up — it does not pretend to be complete. Entries noted by one person are allowed and count, with less weight; entries confirmed by both sides count for more. You must not knowingly add false entries, pretend to be someone you're not, or fake confirmations. Doing so is a serious breach of these terms and our Acceptable Use Policy.
7. Contributors & branded partners
Galleries, venues, and other contributors may start records for artists and add to them, and are credited for what they add. Contributing does not give ownership of the record. If a contributor stops working with the Service, their branding is removed, but the artist's history stays and no certificate or QR code stops working. Branded partners are also bound by their partner agreement.
8. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which forms part of these terms. In particular, the Service is for one-off and numbered physical works by living artists; antiquities, excavated objects, and cultural-heritage material are not covered and cannot be registered.
9. Intellectual property
The Service, including its software, design, and the Attesian name and marks, is owned by us or our licensors. These terms grant you no rights in our intellectual property beyond using the Service as permitted. You keep your Content; we keep our platform.
10. Availability & changes
We may modify or discontinue features of the Service. We will give reasonable notice of important changes to these terms. Importantly, changes to the Service will never cancel certificates already issued or rewrite an existing history — corrections are always added on top, in the open.
11. Liability
The Service is provided “as is”. To the extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential loss, or for losses arising from reliance on self-reported information, pricing ranges, or a third party's contributions. Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud.
12. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without prejudice to any mandatory rights you have as a consumer in your place of residence.
